Amilyar

Amilyar is the Filipino colloquial term for Real Property Tax (RPT), an annual ad valorem tax levied by Local Government Units (LGUs) on land, buildings, machinery, and other improvements based on their assessed value.

Definition

The term "amilyar" derives from the Spanish word "amillaramiento," which refers to the process of property assessment for taxation. In the Philippines, property owners commonly use this term when referring to their annual property tax obligations paid to their city or municipal treasurer's office.

Amilyar is governed by Sections 197 to 283 of Republic Act No. 7160, also known as the Local Government Code of the Philippines.

Key Facts

  • Tax Rate: 1% of assessed value for provinces; up to 2% for cities and municipalities in Metro Manila
  • Due Date: Accrues on January 1 each year
  • Payment: Can be paid annually (with early payment discounts) or quarterly
  • Additional Levy: 1% Special Education Fund (SEF) may be added
  • Penalties: Up to 25% surcharge plus 2% monthly interest on delinquent payments

How Amilyar is Computed

The basic formula for computing amilyar is:

Amilyar = Assessed Value x Tax Rate

Where:

  • Assessed Value = Fair Market Value x Assessment Level
  • Assessment Level = Percentage set by the LGU based on property classification (residential, commercial, industrial, agricultural)

Who Pays Amilyar?

  • Property owners (land, buildings, condominiums)
  • Administrators or legal representatives of property owners
  • Beneficial users of government-owned properties
  • Real estate developers for unsold inventory
  • Condominium unit owners (pro-rata share of land)

Relevance to Property Transactions

When buying property, you should always verify the amilyar status before closing a transaction. Unpaid amilyar becomes a lien on the property, meaning:

  • Delinquent taxes transfer to the new owner
  • Properties with unpaid taxes may be auctioned by the LGU
  • Tax clearance is required for Transfer Certificate of Title processing

For real estate brokers and salespersons, ensuring clients understand their amilyar obligations is part of proper client advisory. Real estate platforms with property management features can help track tax payment schedules and due dates.
