BIR Guidelines

BIR Guidelines are administrative issuances published by the Bureau of Internal Revenue (BIR) that prescribe rules for tax compliance, documentation, and reporting in the Philippines.

These guidelines include Revenue Regulations (RR), Revenue Memorandum Circulars (RMC), and Revenue Memorandum Orders (RMO). They interpret and implement the provisions of the National Internal Revenue Code (NIRC) and establish specific requirements for taxpayers across various industries, including real estate.

Key Provisions

  • Ordinary and Necessary Expense Rule: Business expenses must be appropriate and helpful in developing the taxpayer's operations. The expense need not be habitual—it may be unique or non-recurring.
  • Substantiation Requirement: Expenses must be supported by official receipts, invoices, vouchers, and other adequate accounting records per Sections 34(A)(1)(b) and 237 of the Tax Code.
  • Withholding Tax Compliance: Applicable expenses must be subjected to proper withholding tax before claiming deductions.
  • Record Retention (RR No. 17-2013): Taxpayers must retain hard copies of books of accounts and supporting documents for the first 5 years; electronic copies are permitted for years 6-10.
  • Electronic Record Keeping (RR No. 09-2009): Taxpayers using microfilm, microfiche, or imaging systems must secure a BIR permit before adopting such systems.

Who is Affected?

Penalties

Non-compliance with BIR Guidelines may result in:

  • Disallowance of claimed deductions during tax audits
  • Deficiency tax assessments plus 25% surcharge
  • Interest charges of 12% per annum on unpaid taxes
  • Compromise penalties ranging from PHP 1,000 to PHP 50,000 depending on the violation
  • Criminal prosecution for willful tax evasion under Title X of the NIRC

Relevance to Philippine Real Estate

For real estate brokerages and agents, BIR Guidelines directly impact how commission payouts are documented and claimed as business expenses.

You must maintain proper records of:

  • Referral arrangements: Timestamped records showing when referrals were made and by whom
  • Commission computations: Breakdown of commission splits and override payments
  • Official receipts: BIR-registered receipts for all commission disbursements
  • Withholding tax certificates: BIR Form 2307 for creditable withholding taxes

Platforms like iRealtee support BIR compliance by automatically generating timestamped audit trails for all referral and commission transactions. This documentation helps substantiate business expenses during BIR tax reporting and audits.
