Commission Override

Commission overrides function within a tiered network structure common in Philippine real estate brokerages.

Commission Override

Commission Override is a compensation structure in hierarchical sales organizations where team managers or upline leaders earn additional percentage-based payments from the sales closed by their recruited agents or downline members.

Key Components

  • Override Percentage: A fixed percentage (typically 1% to 5%) paid on top of the direct selling agent's commission
  • Upline-Downline Relationship: The hierarchical structure determining who receives overrides from whose sales
  • Generation Levels: Multiple tiers (e.g., first-level, second-level recruits) that may qualify for override payments
  • Sales Volume Threshold: Minimum team sales targets that must be met before overrides are released

How it Works

Commission overrides function within a tiered network structure common in Philippine real estate brokerages.

  1. A real estate broker recruits and manages a team of salespersons or sub-agents
  2. When a downline agent closes a property sale, the agent earns their direct commission (typically 3% to 5% of the total contract price)
  3. The upline manager automatically receives an override commission from the developer or brokerage firm
  4. Override percentages decrease as the generation level increases (e.g., 2% for first-level, 1% for second-level)
  5. Some brokerages apply a "compression" system where overrides skip inactive uplines and go to the next active manager

Pros & Cons

Advantages:

  • Incentivizes team leaders to recruit, train, and support new agents
  • Creates passive income streams for experienced brokers
  • Encourages mentorship and knowledge transfer within brokerages
  • Aligns team manager interests with overall team performance

Disadvantages:

  • May reduce total commission available to the direct selling agent
  • Complex multi-tier structures can create disputes over commission allocation
  • Risk of becoming a pyramid scheme if recruitment is prioritized over actual sales
  • Administrative burden in tracking multiple override levels

Real-World Application

In Philippine real estate brokerages, commission overrides are standard practice for building and retaining agent networks. A typical structure works as follows:

Example Scenario:

  • A condominium unit sells for PHP 5,000,000
  • Developer pays 5% gross commission = PHP 250,000
  • Direct selling agent receives 60% = PHP 150,000
  • First-level upline (team leader) receives 1.5% override = PHP 75,000
  • Second-level upline (branch manager) receives 0.5% override = PHP 25,000

This structure is particularly prevalent in large brokerages accredited by major developers like Ayala Land, SMDC, and Megaworld.

Under RA 9646 (RESA Law), commission arrangements must flow through a licensed real estate broker. Section 31 explicitly states that salespersons cannot receive compensation from anyone other than the broker who has direct supervision over them. This means override structures must be formalized through brokerage agreements and comply with PRC licensing requirements.

Brokerages using agent network genealogy tracking software can automate override calculations across multiple levels, ensuring accurate and timely commission releases.
