Estate Tax

Estate Tax is a tax concept that imposes a levy on the transfer of a deceased person’s net estate before distribution to heirs.

Definition

Estate tax in the Philippines is imposed under the National Internal Revenue Code (NIRC), as amended by TRAIN Law. It is computed on the net estate (gross estate minus allowable deductions) at a flat 6% rate. Payment and filing are generally due within one year from death, with possible BIR-approved extensions. For real property in the estate, values rely on the higher of fair market value per zonal value or LGU-assessed value, affecting subsequent title transfers via the Registry of Deeds.

Key Components

  • Tax base: net estate (real/personal property less deductions).
  • Rate: flat 6% under TRAIN Law.
  • Valuation: higher of zonal value or LGU assessed value for real property.
  • Filing/payment: BIR Form 1801, within one year from death (extensions subject to BIR approval).
  • Clearances: Estate Tax Clearance and Electronic Certificate Authorizing Registration (eCAR) for property transfers.

How It Works

  1. Executor/heirs list estate assets and liabilities, including real property, bank accounts, and receivables.
  2. Determine gross estate, apply deductions (standard deduction, family home, claims, losses), and compute net estate.
  3. File BIR Form 1801 and pay estate tax; request eCAR for each property.
  4. Present eCAR, tax clearances, and required deeds to the Registry of Deeds for title transfer.
  5. Update Tax Declarations at the LGU after new titles are issued.

Pros & Cons

  • Pros: Flat rate simplifies computation; clearer timelines under TRAIN; deductible standard amounts reduce burden on modest estates.
  • Cons: Requires asset inventory and documents; payment timing can strain liquidity; underpayment blocks title transfers.

Real-World Application (Philippine Real Estate)

  • Heirs must settle estate tax before selling inherited properties; brokers should confirm eCAR issuance before listing.
  • Use Payment Tracking and Document Management System to manage deadlines and store filings.
  • Coordinate valuations with a Real Estate Appraiser and align assessed values with Assessed Value for LGU records.
  • Align onboarding and verification with KYC when dealing with estates and multiple heirs.
